Tool fans must feel like they’re being tortured. Every few months they’re treated to conflicting reports that a new album is on the way, but maybe not, and maybe Maynard James Keenan selling his house is a sign that it is!

Well, it isn’t. But after eight years, we finally know why.

In an interview with Rolling Stone, guitarist Adam Jones explains that they’ve spent the better part of the last decade tangled in a never ending sequence of court battles. In 2007, one of his friends launched a suit claiming he’d done artwork for the band. He wanted credit. Tool sought the help of an insurance company that, instead of working to defend them, piled on with a suit of their own.

In detail, it’s a lot of technicalities. Tool were being sued by the people hired to defend them against a different lawsuit. To cover their asses, they launched a countersuit. This was years ago.

Jones says that while fans need to understand that the music process isn’t necessarily about them, it’s time they know what’s happening.

“It’s costing millions and millions and millions of dollars to defend us,” he said. “And the fans are all going, ‘We want a new Tool album. What the fuck?'”

“The whole thing is really depressing,” adds drummer Danny Carey. “The bad thing is it’s really time consuming.”

And so while Jones, Carey, and bassist Justin Chancellor have been working on music in the years since 10,000 Days, they’re having a hard time balancing the songwriting process with family life and a lawsuit that seems to be never-ending.

Their case apparently goes to court in January, but fans already know that doesn’t mean the next album could be coming soon after. Tool like to lose themselves in the process, something they’ve clearly not been able to do to date.

“I’m hoping that we have something really solid recorded by the end of the year,” Carey explained. “But we’ll see how it goes. I thought that last year, too.”

Of their new music, both Jones and Carey say it’s looking dark, maybe more “metal.” But with only one song nearing completion, it could be a long time before fans know just what that means.
